Welcome to MySportsPool! We provide a software-as-a-service (SaaS) technology platform for individuals to host, manage, and compete in sports-related entertainment contests, such as NFL Survivor pools. Please read these Terms of Service (“Terms”) carefully before using our website, mobile application, or services (collectively, the “Platform”). By registering for an account, opting in, or participating in any sports pools or contests, you agree to be bound by these Terms and the Privacy Notice incorporated herein by reference.

1. Eligibility and Entertainment Only

1.1 Strictly for Entertainment

The Platform is provided strictly for entertainment, amusement, and social purposes only.

We do not facilitate, handle, or process real-money wagering, gambling, or betting. We do not offer or award cash prizes or items of real-world monetary value for participating in pools or contests. Any external arrangements, side-prizes, or financial structures managed independently by pool organizers are strictly outside the scope and operations of the Platform.

1.2 Eligibility

By creating an account, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you do not meet these requirements, you may not access or use the Platform. To use the Platform, you must register for an account. Once you have created an account, you may choose to join specific sports pools or contests (such as NFL Survivor pools). Joining any individual pool or contest is solely and exclusively in your sole discretion.

1.3 User Compliance with Local Laws

You represent and warrant that your use of the Platform, including the creation or management of any pool, complies with all applicable local, state, federal, and international laws (“Applicable Laws”). Certain jurisdictions restrict or prohibit “social gambling” or fee-based sports pools. It is your sole responsibility to ensure compliance with all Applicable Laws. MySportsPool disclaims all liability regarding the legal status of your specific pool under Applicable Laws.

2. Platform Services, Approval Queue, and Technology Fees

2.1 Technology and Software Licensing Fees

MySportsPool charges a technology, hosting, and data-processing fee to pool administrators and/or users to deploy, maintain, and process pool instances and entries. You acknowledge and agree that:

  • 2.1.1 Per-Entry / Per-User Licensing: Fees are charged strictly on a “per-user” or “per-managed-entry” basis to offset the direct costs of providing the Platform, including without limitation, costs of computation, server bandwidth, API data feed, and database storage costs associated with processing and updating individual entry sheets.
  • 2.1.2 Independent of Stakes: All software fees are flat-rate utility charges. They do not scale, fluctuate, or correlate with any real-world value, potential pool stakes, or off-platform payouts.
  • 2.1.3 No “Raking”: We do not take a percentage (“rake”) of any external funds. We have no connection to, or knowledge of, any financial transactions that may or may not occur privately between pool managers and participants.

2.2 Administrative Control and the "Holding Bin" Feature

The Platform offers pool administrators manual user-management tools, including an “Approval Queue” interface to screen and approve participants before they can actively enter a contest and submit picks. By accessing and using the Platform, you acknowledge and agree that:

  • The Approval Queue is a neutral organizational utility provided solely for administrative convenience (e.g., verifying identity, managing private group limits, or coordinating internal invites).
  • The Platform does not automate, track, or integrate approval criteria. Any manual action taken by a pool administrator to move a user from the Approval Queue to an active status is solely the act of that administrator.
  • We have no knowledge of, nor liability for, the criteria used by pool administrators to admit or restrict participants.

3. Data Collection, Marketing, and Information Sharing

To provide the Platform and its functionality, we collect essential account details. By opting in and registering, you explicitly agree to the following data usage practices:

3.1 Shared Affiliate Ecosystem

MySportsPool is part of an integrated sports-entertainment network. You agree that we may share your Personally Identifiable Information (“PII”), including without limitation, your name, email address, and mobile number, with our subsidiaries and affiliates, including SportsVault, LLC (“SportsVault”). You consent to receive promotional offers, system notifications, or content directly from SportsVault. You retain the right to opt out of affiliate marketing communications at any time in accordance with Applicable Law.

3.2 Direct Marketing and On-Site Advertising

We may use your contact details to deliver targeted content, newsletter updates, and promotional deals. Additionally, we may display first-party and third-party advertising (such as content cards or banner placements) on our site based on aggregate or individualized user profile metrics, as more fully described in our Privacy Notice.

3.3 Digital Remarketing and Third-Party Platforms (Meta, Google, etc.)

To acquire new users and optimize our marketing, we may share PII with digital advertising channels, including Meta (Facebook/Instagram) and Google, as more fully described in our Privacy Notice.

4. User Conduct and Fair Play

You agree to use MySportsPool in compliance with Applicable Law and in all cases, in a fair, honest, and respectful manner. You strictly agree not to:

  • Create multiple accounts to manipulate or gain an unfair advantage in a pool or contest.
  • Use any automated scripts, bots, or scraping tools to interact with the Platform.
  • Use the Platform to coordinate, track, or facilitate illegal, real-money gambling groups, or commercial wagering enterprises.
  • Harass, abuse, or engage in toxic behavior toward other users in public or private pool forums.
  • Use the Platform in violation of any laws applicable to you.

We reserve the right to suspend or permanently terminate your account at our sole discretion if we suspect fraudulent activity or a breach of these conduct rules. You agree that we shall have no liability for any such actions taken by us in good faith.

5. Intellectual Property

All content, software, graphics, logos, and features on the Platform are the exclusive property of MySportsPool, or our licensors. By registering, you are granted a limited, non-exclusive, non-transferable, and revocable license to use the Platform for your personal, non-commercial entertainment and agree that you shall have no right to sell, license, or transfer any rights in or to the Platform.

You acknowledge and agree that MySportsPool owns and shall retain all rights, title and interest in and to the Platform, including, without limitation, all copies thereof and all rights to patents, copyrights, trademarks, service marks, trade secrets and other intellectual property rights inherent therein and appurtenant thereto. Nothing herein shall be interpreted to mean, and MySportsPool does not grant you any right or license in any trademark, tradename, trade secrets service mark, insignia, slogan, name, emblem, logo, symbol, design and/or other identifying characteristics owned by or associated with MySportsPool’s parent, subsidiaries or affiliates, in any manner whatsoever.

6. Disclaimers and Limitation of Liability

6.1 "As Is" Basis

The Platform, including, without limitation, all software, documents, functions, materials, graphics, and information made available on or accessed through the Platform, are provided “as is” to the fullest extent permissible by law. MySportsPool and its subsidiaries and affiliates make no representation or warranties or endorsements of any kind whatsoever about: (a) the Platform; (b) the content made available to you through the Platform; (c) the materials, information and functions made accessible by the software used on or accessed through the Platform; (d) the ability of the Platform to work with any particular application; and/or (e) any breach of security associated with the transmission of sensitive or personally identifiable information through the Platform. MySportsPool does not warrant that the functionality of the Platform or any materials or content contained therein will be uninterrupted or error-free, that defects will be corrected, or that the Platform or the servers that make the Platform available are free of viruses or other harmful components.
MySportsPool does not warrant that your activities or use of the Platform is lawful in any particular jurisdiction and, in any event, specifically disclaims such warranties. You understand that by accessing or using the Platform or any of the features of the Platform, you act at your own risk, and you represent and warrant that your activities are lawful in every jurisdiction where you access or use the Platform. Further, MySportsPool and its subsidiaries and affiliates disclaim any express or implied warranties, including, without limitation, noninfringement, merchantability, or fitness for a particular purpose.

MySportsPool and its subsidiaries and affiliates shall not be liable for the use of the Platform and any errors contained therein. Some jurisdictions limit or do not allow the disclaimer of implied or other warranties, so the above disclaimer may not apply to the extent such jurisdiction’s law is applicable to these Terms.

6.2 Limitation of Liability

To the maximum extent permitted by law, MySportsPool, its affiliates, directors, agents, employees, and officers (the “Released Parties”), shall not be liable for any indirect, incidental, special, or consequential damages arising out of your access to or use or inability to use the Platform.
In no event shall the Released Parties’ total liability to you for all damages, losses, or causes of action exceed the lesser of fifty dollars ($50) and the amount you paid, if any, to MySportsPool for the use of or access to the Platform.

The Released Parties will not be liable for any failure or delay in their performance due to any cause beyond their reasonable control, including without limitation, acts of war, acts of God, acts of third parties, earthquake, flood, embargo, riot, sabotage, labor shortage or dispute, governmental act, hosting providers, power failure or failure of the internet or computer equipment.

You acknowledge and agree that if you incur any damages that arise out of the Released Parties’ acts or omissions, the damages, if any, are not irreparable and are not sufficient to entitle you to an injunction or other equitable relief restricting operation of the Platform or any other service, property, product, program, or other content owned or controlled by MySportsPool or its parent, subsidiaries or affiliates.

7. Indemnity

You agree to defend, indemnify and hold harmless MySportsPool and its parent, subsidiaries, officers, directors, employees, agents and affiliates with respect to any and all costs, claims, demands, investigations, liabilities, losses, damages, judgments, settlements, costs and expenses, including attorneys’ fees, arising out of or in connection with these Terms, including, without limitation, your access to or use of the Platform. Notwithstanding the foregoing, MySportsPool retains the exclusive right to settle, compromise and pay any and all claims, demands, proceedings, suits, actions or causes of actions which are brought against MySportsPool herein under the terms and provisions of this Section 7 and in no event shall you settle any such claim without MySportsPool’s prior written approval.

8. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal obligations. We will notify you of such modifications or changes by updating the “Last Updated” date at the top of this page or by sending a notification to the email address associated with your account. Your continued use of the Platform after changes are posted constitutes your acceptance of these Terms, as the same may be modified or revised.

9. Dispute Resolution and Governing Law

9.1 Third-Party Disputes

Any private arrangements, side-agreements, or disputes regarding “bragging rights” or external interactions between users within a pool are strictly between those users. We assume no liability or responsibility for user disputes.

9.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of New York without regard to its conflict of law principles. Any disputes arising out of these Terms shall be resolved exclusively through binding arbitration and shall be resolved exclusively by the federal and state courts located in the State of New York, County of Manhattan. By accessing or using the Platform, you expressly consent to the laying of venue in such courts and agree to not challenge such jurisdiction.
